The listed fees for legal services is subject to change; all fees must be negotiated with the attorney before they are set at any specific rate or amount.
Where a minimum is indicated, this minimum amount must be paid at initiation of representation and said payment is nonrefundable.
I do not handle client trust funds. All fees paid to me are to be considered nonrefundable, whether payment is for past, present or future services. Where warranted, the client may be reimbursed for fees already paid to the attorney [e.g., the attorney withdraws his services prior to completion of the assigned task where the reason for withdrawal is personal to the attorney and is not the result of any action by the client].
Payment schedules can be negotiated where circumstances warrant.
Charges required by the courts, government departments, agencies, process servers, court reporters, notaries public, newspapers (where publication is required) and other costs outside of the control of the attorney are not included in the fees for legal services quoted below; such "fees" are the responsibility of the client and may be billed to the client as a separate entry on the billing statement. Wherever the phrase "plus fees" appears, it is probable that such fees will be applicable.
In addition, the client is responsible for postage, copying charges, long distance charges, deposition costs, investigative fees charged by appropriate agencies (where necessary), etc.
Unless otherwise indicated, where an hourly attorney fee is charged, the client must make an initial nonrefundable payment equal to four hours billing. After the initial four hours of attorney time, clients are billed in increments of 1/10 of an hour. Unless prior arrangements are made, all legal fees must be paid within seven (7) days following presentment of the bill for services rendered or the attorney may withdraw from representation (unless actually presented to the client, the date of presentment is the date the bill was deposited in the mails for delivery). The client remains liable for all unpaid attorney fees even though the attorney may no longer be representing him or her. Unpaid attorney fees are assessed interest at the rate of 18% per annum beginning thirty days after the fees become due and owing.

The client will be required to execute a fee agreement letter and make an initial nonrefundable payment equal to the minimum amount stated (except where otherwise noted), plus a deposit equal to the estimated fees and costs required; substantially greater deposits may be required for extraordinary circumstances.
Where notice or service by first class mail or certified or registered mail is necessary, the client is responsible for all costs related to such mailings, including the cost of postage.
If the attorney is required to travel outside a 50 mile radius of the Sagadahoc County (Maine) Courthouse, the client is responsible for all travel expenses (airfare, mileage, lodging, car rental, meals, etc.) related thereto in addition to the legal fees charged; additionally, a per diem charge may be assessed for each day the attorney is required to remain overnight at any location. For overnight or extended travel situations, attorney time is considered to be the lesser of 10 hours or actual time (including travel time) for each day.
All transactions which include real property presume that the client orders, pays for, and furnishes to the attorney either a title commitment, title run sheet, or an abstractor's certificate from a title company. Otherwise, the client must sign a release and indemnify the attorney for any actions or claims arising as a result of a title defect.
Client must provide all necessary witnesses. Attorney will perform any notarial services required at no additional charge.

ALL FEES DUE BEYOND THE INITIAL PAYMENT ARE BILLED WEEKLY AND ARE DUE NO LATER THAN THE 7TH DAY FOLLOWING THE DATE BILL IS MAILED. ANY LATE PAYMENTS [OR ANY FAILURE TO PAY] CONSTITUTE REASONABLE CAUSE FOR WITHDRAWAL OF REPRESENTATION. ADDITIONALLY, SUIT MAY BE FILED FOR THE RECOVERY OF UNPAID FEES AND COSTS. NO PAYMENT MADE TO THE ATTORNEY IS REFUNDABLE FOR ANY REASON UNLESS AGREED TO BY THE ATTORNEY.

When the legal matter for which the attorney was retained is completed, the attorney is under no further obligation to client unless the agreement between the attorney and the client specifically addresses future obligations.

Reduced fee services are not available for civil matters which involve court appearances and are very limited in criminal matters. Please note that I do not accept contingency fee cases (including personal injury, worker’s comp and social security cases) under any circumstances. You will be required to verify your income level
PRO BONO REPRESENTATION
I also provide pro bono (free) representation for elder citizens (65 or over) and persons with disabilities who cannot otherwise afford an attorney for matters such as Powers of Attorney, Wills, Estate Planning, consultations and other transactional services which do not require court appearances. In most circumstances, I will provide these same services for other individuals or families whose income is below the Federal poverty guidelines (you may be required to verify your income level). Please note that the number of such cases undertaken at any given point is limited.
